59A. Deletion and addition of certain entries relating to certain firms, by reason of reorganisation of states
(1)NotwithstandinganythingcontainedinthisChapter,aRegistrarofFirms appointedforanyareabytheGovernmentofBombaymay,byorderinwriting, amendtheRegisterofFirmsmaintainedbyhimbydeletingtherefromtheentries relatingtoanyfirm,whoseplaceofbusinesshas,byreasonofthereorganisationof StatesundertheStatesReorganisationAct,1956,ceasedtobesituatedintheState ofBombay.TheRegistrarmaylikewiseandwithoutanychargeorfeetherefor amendtheRegisterbyaddingtheretotheentriesrelatingtoanyfirmincludedinthe RegisterofanotherStatebutwhoseplaceofbusinesshas,byreasonofsuch reorganisation,becomepartoftheareawithinhisjurisdictionintheStateofBombay:
ProvidedthattheRegistrarshall,beforepassinganyorderunderthissub-section, makesuchinquiryashedeemsnecessaryandgivenoticetothefirmandthe RegistraroftheStateconcerned.
(2)Aftersuchamendment,theRegistrarshallceasetoperformthefunctionsofa Registrarinrespectofanyfirmtheentriesrelatingtowhichhavebeendeletedas aforesaidandshallperformallthefunctionsofaRegistrarinrespectofanyfirmthe entriesrelatingtowhichareaddedasaforesaid.
(3)Anypersonaggrievedbyanorderundersub-section(1)mayappealtosuch authority,andwithinsuchtime,asmaybespecifiedinthisbehalfbythe GovernmentofBombaynotificationintheOfficialGazette;andsuchauthorityshall passsuchorderontheappealasitthinksfit.
(4)AnorderofaRegistrarundersub-section(1),orwhenanappealhasbeen preferredagainstitundersub-section(3),theorderoftheappellateauthority,shall befinal.
(5)Theprovisionsofthissectionshallceasetobeinforcefromsuchdateasthe GovernmentofBombaymay,bynotificationintheOfficialGazette,appoint.
